Vertical Works Regulations

1 General legislation.

The current legislation considers vertical works as jobs typical of the field of construction. In many cases, vertical works are used to execute parts of the works, to carry out maintenance of facilities and buildings or to carry out conservation operations (cleaning, painting, etc.). That is why, whenever work is carried out within this area, all the legislation that applies to the construction sector must be taken into account. Below is a list of the main legislation that may affect vertical work in construction .

Minimum Provisions:

• Royal Decree 1627/1997, of October 24, which establishes the minimum health and safety provisions in construction works, modified by Royal Decree 2177/2004, of November 12, on work at height , Royal Decree 604/2006, of May 19, regarding the presence of preventive resources and Royal Decree 337/2010, of March 19.

Outsourcing:

• Law 32/2006, of October 18, regulating subcontracting in the Construction Sector, modified by Law 25/2009, of December 22.

• Royal Decree 1109/2007, of August 24, which develops Law 32/2006, of October 18, regulating subcontracting in the construction sector, modified by Royal Decree 327/2009, of 13 of March and Royal Decree 337/2010, of March 19.


Guestbook and opening communication:

• Royal Decree-Law 1/1986, of March 14, on urgent administrative, financial, fiscal and labor measures, modified on several occasions, among which Law 25/2009, of December 22, stands out. • Order TIN/1071 /2010, of April 27, on the requirements and data that communications for the opening or resumption of activities in work centers must meet. • Resolution of February 18, 1998, of the General Directorate of Labor and Social Security, on the Labor and Social Security Inspectorate's guest book. • Resolution of April 11, 2006, of the Labor and Social Security Inspectorate, on the Labor and Social Security Inspectorate's Guest Book.

Edification:

• Law 38/1999, of November 5, on Building Planning, modified by Law 25/2009, of December 22. • Decree 3565/1972 of December 23, which establishes the technological standards of the edification. Royal Decree 570/1981 of March 6, which empowers the Minister of Public Works and Town Planning to modify the annex to D3565/1972, Ministerial Order of May 23, 1983, which modifies the systematic classification contained in the annex of Decree 3565/1972, Ministerial Order of July 4, 1983, which establishes a new systematic classification of technological building standards.

 

1 Applicable legislation

• Royal Decree 314/2006, of March 17, approving the Technical Building Code.

• Royal Decree 1371/2007, of October 19, which approves the basic document "DB-HR Protection against noise" of the Technical Building Code and modifies Royal Decree 314/2006, of March 17, which approves the Technical Building Code.

• Ministerial Order of June 9, 1971, which dictates the rules on the book of orders and assistance in building works. Modified by Ministerial Order of July 17, 1971.

• Ministerial Order of January 28, 1972, which regulates the final certificate of the building works management. • Resolution of April 8, 1999, of the Secretary of State for Waters and Coasts, on the delegation of powers in health and safety at construction sites.

 

Machinery:

• Royal Decree 212/2002, of February 22, which regulates noise emissions in the environment due to certain machines used outdoors.

• RD 524/2006, of April 28, which modifies Royal Decree 212/2002, of February 22, which regulates noise emissions in the environment due to certain machines used outdoors.

• Royal Decree 836/2003 of June 27, which approves a new complementary Technical Instruction "MIE-AEM-2" of the Regulation of Lifting and Handling Devices, referring to tower cranes for works or other applications.

• Royal Decree 837/2003 of June 27, which approves the new modified and consolidated text of the Complementary Technical Instruction "MIE-AEM-4" of the Regulation of Lifting and Handling Devices, referring to self-propelled mobile cranes.

• RD 1644/2008, of October 10, which establishes the rules for the marketing and commissioning of machines.
