Assembly and disassembly of awnings
Our company installs awnings using the mandatory UNE-EN 13561 Regulation.
In 2004, the European Regulation UNE-EN 13561 was approved, mandatory for all companies that manufacture and install awnings on building facades. In this way they guarantee quality standards and companies are obliged to specify their performance: resistance to wind, snow, dammed water, durability, manoeuvrability...
There is also regulation by the municipalities. Depending on where you live, you may or may not request a municipal license to install the awning. We recommend that you inform yourself well before doing the installation.
Installing awnings in your community of neighbors can generate many conflicts, especially if the regulations are not respected or the necessary permits are not requested.
Article 7 of the Horizontal Property Law establishes that an owner may not make modifications to the architectural elements of the building when this alters its structure or its external state, and installing an awning anchored by means of a metallic structure to the façade would fall within this assumption. .
For this reason, you should consult with the Estate Administrator or the president of the community. When doing so you can find two different situations:

In this case, you will not have to ask the Community for permission, just comply with the established rules. In this case, the color, model and dimensions that the awnings installed in the Community must have to give a uniform and visually pleasing appearance to the building will surely be specified.
In this case, you must request an item on the agenda at the Homeowners' Meeting to obtain permission. You will need a majority of 3/5 votes in favor, which is equivalent to 3/5 participation fees.
The community must also reach an agreement on the model, color and dimensions of the awnings that are installed. To reach this agreement, a simple majority will suffice.
It is important that the interested owner requests an item on the agenda, since, if the subject is dealt with during the round of questions and answers, the agreement reached will not be valid and may be challenged.
If you cannot reach an agreement with your Community of Neighbors, and yet there are already other awnings already in place of the same size, color and characteristics as the one you want to install, you can file a complaint for discrimination as there is a comparative offense.
In conclusion, it is possible to install awnings in the Community of Neighbors as long as the regulations are complied with and the necessary agreements are reached with the rest of the owners.
